Is there a difference between receiving a citation and receiving a notice of non-renewal?
Yes. Citations are issued by the Pennsylvania State Police, Bureau of Liquor Code Enforcement (BCLE). In general BCLE enforces provisions of the liquor code and its attendant regulations. Citation penalties range from payment of fine, period of suspension of the license, or revocation of the license. Non-renewal actions are issued by the PLCB Bureau of Licensing. These actions do not result in a fine or suspension. The result of a non-renewal action is the cessation of the liquor license. It is the “death penalty” for liquor licenses.
Should a Licensee simply waive a citation action and pay the fine recommended by BCLE?
No. Although a citation action usually results in a fine or suspension of the liquor license, the appellate courts have ruled that waiver of citation actions is an act of “indifference” to the license. Upon renewal of the license, PLCB Bureau of Licensing can use acts of “indifference” to the license as a reason to non-renew the license.

Yes. The Liquor Code and its attendant regulations are a complex body of law. Ancillary actions may develop which can place the license in jeopardy. Liquor licenses are valuable assets.
