What Is Title IX?

Title IX is a federal statute. Among other things, Title IX attempts to protect the rights of an individual from being discriminated based on their sex from participating in education or other campus activities. One of the purposes of Title IX is to insure equal access to education.

Title IX Process

Each institution of higher education employs a Title IX officer. Many also have Title IX investigators. When an individual makes a claim of being sexually assaulted or harassed, a complaint will be filed against the alleged perpetrator.

The college/university will conduct an investigation, including interviewing all parties involved and potential witnesses. The results of which are memorialized in an investigative report. Ultimately, many of these matters proceed to a hearing.

Title IX hearings are brought before a board comprised of individuals affiliated with the college/university. Board members may include professors, administrators, and students. After a hearing, this board will determine if an offense has occurred. If there is a finding that an offense occurred, this same board will determine the sanction. Sanctions could range from a reprimand, probation, suspension, or expulsion from the college/university.
